Lawyer In Triple Killing Wants Statements Tossed

The lawyer for the second man facing trial in a Berkshire County triple killing has asked a judge to dismiss as evidence several statements made by jailhouse informants he said are "irrelevant and unduly prejudicial."

David Chalue, 47, of North Adams, is scheduled to face trial April 22 in the deaths of David Glasser, Robert Chadwell and Edward Frampton, all of Pittsfield, in 2011.

The trial is scheduled to be held in Hampden Superior Court because of the large amount of publicity the killings received in Berkshire County. Chalue has pleaded not guilty to three counts each of murder, kidnapping and witness intimidation.

Chalue's lawyer, Donald Frank, has filed several motions in advance of the trial, including efforts to dismiss the statements from the informants, The Berkshire Eagle reported.

The informants say Chalue made incriminating statements to them while they were in jail together.

Chalue's attorney also requested the court to suppress anything found in three searches of Chalue's jail cell because the searches violated his civil rights and attorney-client privileges.

The motions will be heard April 11.

Adam Lee Hall of Peru, Mass., was convicted in February of three counts of murder and is serving three life sentences.

Hall wanted Glasser killed to prevent him from testifying in an unrelated assault case, while the other two men were killed to get rid of witnesses, prosecutors say. Their dismembered bodies were found buried in Becket weeks later.

Three people were charged in the killings while a fourth is charged with helping dispose of the bodies.
