Eyewitness: Henry's Car Sped Up, Hitting Cop

An eyewitness says a Pace University football player killed by police came to a near-stop when an officer stepped in front of his car but then sped up and struck him.

Danroy Henry Jr. of Easton, Mass., died last October at a Thornwood, N.Y., shopping mall. Students had spilled into the parking lot during a homecoming celebration.

Finnegan's Grill owner Stephen Van Ostrand tells The Journal News that Officer Aaron Hess put up his hand and Henry slowed down.

He says Hess then yelled "stop" but Henry "hit the gas pedal." Ostrand says Hess was knocked onto the hood and opened fire.

Ostrand testified before a Westchester County grand jury, which declined to indict Hess and another officer.

Henry's family attorney was not immediately available for comment.
