Defense Says Marathon Bombing Suspect's Remark Meant To Be Humorous

Lawyers for Boston Marathon bombing suspect Dzhokhar Tsarnaev say a remark he made to his sister during a prison visit was meant to be humorous and was not something incriminating, as prosecutors have suggested.

In court documents filed Wednesday, Tsaranaev's lawyers responded to a claim by prosecutors that Tsarnaev made a remark "to his detriment" that was overheard by an FBI agent who was allowed to be in the room because of special restrictions placed on Tsarnaev in prison.

Neither side revealed what Tsarnaev said.

But Tsarnaev's lawyers said his comment was "jocular" or "gently mocking" toward the alleged security concerns that prompted the prison restrictions, and did not relate to the charges against him.

Tsarnaev faces the possibility of the death penalty in the April 15 bombing, which killed three people and injured more than 260.
