Appeals Court Hears Request To Recuse Bulger Judge

Before a federal appeals court Tuesday, the defense team for James Whitey Bulger argued that Judge Richard Stearns should not preside over the pending trial of the reputed Boston mobster.

The reason? Stearns was a top federal prosecutor while Bulger was an FBI informant.

Bulger's attorney, J.W. Carney, said that means Stearns would be unable to rule impartially in the trial. Bulger, who's charged with 19 murders, intends to defend himself.
