Judge Denies Request In Marathon Bombing Case

A request by lawyers for Boston Marathon bombing suspect Dzhokhar Tsarnaev for prosecutors to turn over more evidence has been rejected.

A federal judge on Wednesday denied the request except for a portion that required prosecutors to release actual recordings of Tsarnaev's telephone calls from jail instead of transcripts.

Attorneys for Tsarnaev said they needed the additional evidence as they prepare to defend against a potential death penalty.

Tsarnaev's lawyers have complained that prosecutors have failed to turn over several types of evidence they believe could help them argue against the death penalty, including information on a 2011 triple slaying in Waltham in which Tsarnaev's older brother, Tamerlan, is a suspect.

The lawyers have argued that any evidence of Tamerlan's involvement in the slayings is mitigating information that is important to their client's defense.
