The state's highest court ruled Tuesday that there may be times black men are justified in fleeing police.

The justices ruled unanimously to toss out the gun-related conviction of a black man arrested after he fled Boston police who were originally investigating a break-in.

They said a history of racial profiling by Boston police gave him reason to flee.

Retired federal Judge Nancy Gertner, a Radio Boston legal analyst, discusses with WBUR.

This segment aired on September 21, 2016.
