Bulger Defense Takes Judge Request To Appeals Court

The defense lawyer for accused Boston mob boss James "Whitey" Bulger is taking his request for a new trial judge to a federal appeals court.

Attorney J.W. Carney argues in a motion filed Wednesday that the decision by Judge Richard Stearns to remain on the case threatens the integrity of the process.

Carney says Stearns' ability to be impartial is in doubt because he was a prosecutor in the U.S. Attorney's Office at the time that Bulger was an FBI informant.
