READ: Court of Appeals Orders New Death Penalty Phase For Tsarnaev

The First Circuit Court of Appeals Friday ordered a new penalty phase in the trial of Dzhokhar Tsarnaev, who was convicted of killing four people and injuring more than 260 others during the Boston Marathon bombing and in the days following the attack.

Tsarnaev admitted to planning and executing the deadly attacks ahead of his trial in 2015.

In the 182-page ruling released Friday, Judge O. Rogeriee Thompson wrote that the trial judge in the case, George O'Toole, did not adequately weigh whether each juror had ignored pretrial publicity about a case.
