Lawyers for Marcus Hurd, the sole survivor of the so-called Mattapan Massacre of 2010, now say that he can positively identify Dwayne Moore as one of the shooters. Last March, Edward Washington was acquitted of all charges, but the case against Moore ended in a deadlocked jury.

At the suspects' original trial, Hurd did not identify either assailant, saying that he couldn't see either of their faces or skin. According to papers filed by the prosecution last Friday, Hurd now claims that he recognized Moore during that trial. The prosecution would like to introduce Hurd's new testimony at Moore's re-trial in October.

A hearing is being held at Suffolk Superior Court today to review this new evidence.
